U.S. Treasury Secretary Scott Bessent voiced confidence on Monday that the Supreme Court will uphold President Trump's use of the 1977 International Emergency Economic Powers Act (IEEPA) to impose broad tariffs, but noted the administration has a contingency plan if it doesn't. Bessent is preparing a legal brief emphasizing the need to correct long-standing trade imbalances and curb fentanyl imports. A divided U.S. appeals court recently ruled 7–4 that most of Trump's tariffs are illegal, though they remain in effect until October 14 pending a Supreme Court appeal. The ruling targets "reciprocal" tariffs from April and fentanyl-related tariffs from February, but does not impact levies under other legal grounds, such as those on steel and aluminum. Trump invoked IEEPA to justify these measures, citing "unusual and extraordinary" threats during national emergencies.
